Terms of Use

1. Introduction

Welcome to NYUZI Crafts Studio ("we", "our", "us"). These Terms of Use ("Terms") govern your access to and use of our website and marketplace at https://nyuzicrafts.com(the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

2. Definitions

"Artisan"
A registered user who offers handcrafted crochet products and services through the Platform.
"Customer"
A registered user who browses, inquires about, and places orders for products from Artisans.
"Order"
A request by a Customer for a product or service from an Artisan, including all stages from inquiry to completion.
"Content"
All text, images, descriptions, and materials uploaded by users to the Platform.

3. Eligibility & Accounts

  • You must be at least 18 years old to create an account and use the Platform.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
  • You must provide accurate, current, and complete information during registration and keep it updated.
  • Artisans must have a physical workshop/office in Tanzania and provide valid location details for verification.

4. Artisan Application & Approval

  • Artisans must submit an application with business details, portfolio, and location.
  • Applications are reviewed by our admin team. Approval is at our sole discretion.
  • Approved artisans receive an "Artisan Profile" and may list products and accept orders.
  • We reserve the right to reject, suspend, or revoke artisan status for violations of these Terms or quality standards.

5. Orders & Transactions

  • Orders progress through stages: inquiry → quoted → accepted → in_progress → completed (with branches for cancelled, disputed, rejected).
  • Pricing: Artisans set their own prices. NYUZI does not dictate pricing but reserves the right to remove listings that appear fraudulent or misleading.
  • Payments: Arranged directly between Customer and Artisan. NYUZI does not process payments or hold funds.
  • Quote stage: Artisan provides a quote. Customer may accept, request revisions, or decline.
  • Completion: Artisan marks order complete. Customer has 7 days to confirm or raise a dispute.

6. Messaging & Communication

  • In-app messaging is provided for order-related communication.
  • Do not share personal contact info (phone, email, WhatsApp) before order acceptance.
  • We monitor messages for spam, fraud, and policy violations.
  • Messages are visible to both parties and NYUZI admins for dispute resolution.

7. Reviews & Ratings

  • Customers may leave a 1–5 star rating after order completion.
  • Ratings are private to the artisan until they also rate (or 14 days pass).
  • Reviews must be honest, relevant, and non-abusive. We may remove fake or defamatory reviews.
  • Artisans cannot incentivize positive reviews or retaliate against negative ones.

8. Intellectual Property

  • You retain ownership of your Content. By uploading, you grant NYUZI a non-exclusive, royalty-free license to display, distribute, and promote your Content on the Platform.
  • NYUZI branding, design, and platform code are our property. No license is granted for commercial use.
  • Do not upload Content you don't own or have rights to. We respond to DMCA takedown notices.

9. Prohibited Conduct

You may not:

  • Use the Platform for illegal activities or to sell prohibited items.
  • Impersonate another user or misrepresent your identity/location.
  • Scrape, crawl, or extract data without written permission.
  • Interfere with Platform security or attempt unauthorized access.
  • Harass, threaten, or discriminate against other users.
  • Post false, misleading, or defamatory content.
  • Circumvent the Platform (e.g., direct payments to avoid fees, if any).

10. Suspension & Termination

  • We may suspend or terminate your account for Terms violations, with notice (except for severe violations like fraud or safety risks).
  • Artisans: Suspension pauses order acceptance. Existing orders proceed unless terminated by admin.
  • You may delete your account anytime. Deletion anonymizes personal data; order history remains for other parties.

11. Disclaimers & Limitation of Liability

  • The Platform is provided "as is" without warranties of merchantability, fitness for purpose, or non-infringement.
  • NYUZI is a marketplace facilitator, not a party to transactions. We are not liable for product quality, delivery, disputes, or damages between users.
  • To the maximum extent permitted by law, NYUZI's aggregate liability shall not exceed the fees paid by you (if any) in the 12 months preceding the claim.
  • We are not responsible for third-party links, services, or content accessible through the Platform.

12. Indemnification

You agree to indemnify and hold NYUZI, its officers, and employees harmless from any claims, damages, or expenses arising from your use of the Platform, violation of these Terms, or infringement of third-party rights.

13. Dispute Resolution

  • Disputes between Customer and Artisan: Use in-app messaging first. Escalate to NYUZI support for mediation.
  • Legal disputes: Governed by laws of Tanzania. Exclusive jurisdiction: courts of Dodoma, Tanzania.
  • You may also contact the Tanzania Consumer Protection Council for consumer disputes.

14. Changes to Terms

We may update these Terms. Material changes will be posted on this page with a new "Last updated" date and emailed to registered users. Continued use after changes constitutes acceptance.
